TERMS OF SERVICE

By creating an account or using the apexr website at apexr.ai (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

1. The service

apexr is a karting coaching tool that provides AI-assisted video analysis, racing-line generation from track images, and a library of driving exercises. The Service is provided "as is" and is intended as a coaching aid, not as a substitute for professional instruction or safety equipment.

2. Account and eligibility

You must be at least 13 years old to create an account. You are responsible for keeping your login credentials secure and for all activity that occurs under your account.

3. Acceptable use

You agree not to:

• Upload content you do not have the rights to use.
• Upload content that is illegal, harmful, or infringes others' rights.
• Attempt to reverse-engineer, scrape, or overload the Service.
• Resell access to the Service without our written permission.
• Use the Service to develop a competing product.

We may suspend or terminate accounts that violate these terms.

4. Credits, subscriptions, and payments

Credits. One video analysis costs 5 credits. Subscription credits reset on each billing cycle and do not roll over. Top-up credits never expire.

Subscriptions. Starter, Pro, and Elite subscriptions renew automatically each month at the price shown on the pricing page until canceled. You may cancel at any time via the Manage Subscription portal accessible from your account page; cancellation takes effect at the end of the current billing period.

Top-ups. Top-up credit packs are one-time purchases and do not renew.

Lifetime / Founding Member. The $149 Founding Member purchase is a one-time payment that grants the Elite credit allotment every month for the lifetime of the Service. The number of Founding Member slots is limited.

Free trial. Starter and Pro subscriptions include a 7-day free trial. You may cancel during the trial without being charged. Elite has no trial.

Refunds. Stripe processes all payments. We will refund a charge if you contact us within 7 days of the purchase, and on a case-by-case basis after that. If a video analysis fails on our end, the credits are automatically refunded to your account.

Price changes. We may change prices for new purchases. Existing subscribers will be notified at least 30 days before any price change applies to their plan.

5. Your content and license

You retain ownership of the videos and images you upload. By uploading, you grant us a limited license to store, process, and display your content for the sole purpose of providing the Service to you. We do not use your content to train machine-learning models, and we do not share your content with third parties except as required to deliver the Service (e.g., sending the video to Google's Gemini API for analysis).

6. Our content

The Service, including the analysis output, the exercise library, the racing line algorithm, the brand, and the website itself, is owned by us or our licensors and is protected by intellectual property laws. You may use the output for personal coaching purposes; you may not redistribute it commercially without permission.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind. We do not warrant that the analysis will be accurate, that the Service will be uninterrupted, or that any specific result will be achieved. Karting involves inherent risks; always follow the safety procedures of your kart, your track, and your sanctioning body.

8. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or related to the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

9. Termination

You can stop using the Service at any time. We can suspend or terminate your account if you violate these terms, if your account is inactive for an extended period, or if we discontinue the Service. Unused subscription credits do not refund on cancellation; unused top-up credits remain available until the Service is discontinued or your account is deleted.

10. Changes to these terms

We may update these terms from time to time. Material changes will be communicated by email or in-app notice at least 14 days before they take effect. Continued use of the Service after a change means you accept the new terms.

11. Governing law

These terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in California.
